Despite a funding cut-off
threat from the Justice Department, over 300 so-called "sanctuary
cities" are illegally protecting thousands of illegal criminal aliens and terrorists
from federal arrest and deportation, according to a new analysis.
Criminal
foreigners illegally in this country are being shielded from justice by criminal,
“sanctuary city” policies, said Attorney General Jeff Sessions on Monday.
If
you live in’, or anywhere near’ one of the cities counties or states I hope you
carry a gun, your life is or will be in danger.
Because as dangerous as they are now, they will only get worse. Moreover, they are all in violation of Federal
and Constitutional law. Even states laws
prohibit the protection and harboring of known criminals.
California
is even threatening secession to protect the terrorists, criminals, and rapists
illegally pouring into the state. But
then what can one expect from a bunch of useful idiots and Communist Fabians.
Reading
his prepared statement, A.G. Sessions repeated a previous commitment to lawfully withhold federal
funding, from states and localities that refuse to comply with lawful detention
and transfer orders from federal immigration authorities.
Jurisdictions operating
“sanctuary” policies, said Sessions, are refusing to comply with detainer
requests from Immigration and Customs Enforcement (ICE) for illegal aliens
charged or convicted with “serious crimes,” including murder, rape, assault, and
sexual abuse of children, drug trafficking, and intoxicated driving.
"Countless Americans would be alive today – and countless loved ones would
not be grieving today – if the policies of these sanctuary jurisdictions were
ended,"
said Sessions. Sessions pointed to a Department of
Homeland Security (DHS) report identifying over 200 instances in a single week
(January 28 - February 3, 2017) where “sanctuary” jurisdictions refused to
honor detainer requests filed by ICE.
“We the People of the United States, in Order to form a more perfect Union, establish Justice, insure domestic Tranquility, provide for the common defense, promote the general Welfare, and secure the Blessings of Liberty to ourselves and our Posterity, do ordain and establish this Constitution for the United States of America.”
While there are only two specific references in the Constitution to immigration , stated in this most important of documents as , “naturalization, ” there is clear evidence by the Framers as to what they intended concerning the rights of the people who live in this country and how those rights affect immigrants and illegal aliens.
The two references in the Constitution that specifically mention , “naturalization, ” are found in Article I, Section 8 in creating the authority of the Congress, “To establish an uniform Rule of Naturalization.” Thus from a Constitutional stand point it is the responsibility of Congress to establish all laws and rules of naturalization or immigration. Not the states.
The second reference is located in the 14th Amendment shown above stating that, “All persons born or naturalized in the United States,” are, “citizens of the United States and of the State wherein they reside.”
The key thought in the 14th Amendment which along with several other provisions established in the Constitution shows that the intent of the Framers was that only citizens of the United States whether born or naturalized are granted the rights and privileges that are available in America.
"Sanctuary city" policies, said Sessions,
endanger Americans: "Such policies cannot
continue. They make our nation less safe by putting dangerous criminals
back on our streets."
The example of Kate Steinle, who
was shot and killed in July 2015 by an illegal alien Mexican who was deported 5
times, was protected by the sanctuary city of San Francisco, was mentioned by
Sessions:
"We all remember the tragic
case of Kate Steinle, the 32-year-old woman who was shot and killed two years
ago in San Francisco as she walked along a pier with her father. The
shooter, Francisco Sanchez, was an illegal immigrant who had already been
deported five times and had seven felony convictions.
Just eleven weeks before the
shooting, San Francisco had released Sanchez from its custody, even though ICE
had filed a detainer requesting that he be kept in custody until immigration
authorities could pick him up for removal. Even worse, Sanchez admitted
that the only reason he came to San Francisco was because of its sanctuary
policies."
Steinle's death was regularly
mentioned by President Donald Trump during his presidential campaign as one
well known extreme example of the dangers posed by the status quo of
illegal aliens, for which he was demonized as an immigrant hater and a racist.
Sessions also called for states
and localities to comply with 8 U.S. Code § 1373,
which generally prohibits any government entity from interfering with the
transmission or reception of information regarding the immigration status of
any individual.
THE BOTTOM LINE: Whenever a question arises concerning an important issue
such as immigration, the best and most reliable source for finding what this
Nation should do in solving any problem that we face is to look to the United
States Constitution.
Over the years I have posted
many articles on the Constitution. I have claimed that I am a Constitutional
scholar, not because I am so educated, even though I do have two degrees on
Constitutional studies from the University of Hillsdale in Hillsdale
Michigan,(something that anyone can do by the way), but because the general
American population are so uneducated. I
do believe that as a citizen of this Free Republic it is our responsibility to
know our Constitutional Law and understand the true and real intent of our
Founders in writing this wonderful inspired document. Something that even most
of our Supreme Court Justices do not know or much less care about.
While the Declaration
of Independence documents our God given rights of, “life, liberty and the pursuit of
happiness,” the Constitution by the rule of law, insures that those
rights are protected even from the federal and state governments.
