Prop 8, We The People

Prop 22/8 back in court again…
The people of California have a unique power that few States have; it is the ’Initiative Referendum’ of directly making law, and bypassing the legislature altogether. This is actually an indirect result of the loss of our Republic, and the introduction of Democracy in America which occurred in 1913 by the passage of the 17th Amendment.

The Initiative Referendum is actually a sophisticated form of vigilantism. This becomes necessary when the representative system no longer works, or as in our case, has been distroyed.

In 2000, 61% of California voters used this Initiative and approved a ballot measure, Proposition 22 that said "only marriage between a man and a woman is valid and recognized in California."

And then, this year the California Supreme Court struck down this new law made by the people on same-sex marriage in a broadly worded decision that would invalidate virtually any law that prohibits marriage on the basis of sexual orientation. In the 4-3 ruling the court declared that the state Constitution protects a fundamental "right to marry" that extends equally to same-sex couples. It tossed a highly emotional issue into the election year while opening the way for tens of thousands of gay people to wed in California, starting as early as mid-June.

So let’s recap.
First, the State legislature refuses to write a law that the people want, so the system of representing the people fails. Second, the people use the people’s initiative to pass a law that the people want, (prop 22). Third the court overturns the people’s law and writes a new one. Forth, the people pass yet another law, (prop 8) overturning the court legislated law, and now fifth, the new peoples initiative referendum, will end up in court once again. Did I get that about right?

This, my friend, all because we ignored Constitutional law back in 1913 and with the seventeenth Amendment destroyed the Representative Republic that the Constitutional architects designed and in its place created a true democracy. Democracy’s, by there very nature do not, and never have worked.

So the vigilante people must do the only alterative left and that is to take the law into their own hands, which is what the people did through the initiative process, prop 22 in 2000. This was a legal process. The court on the other hand, violated the Federal and the State Constitutional law when they over turned the peoples law and made a new law they liked better. Courts, not even the Federal Supreme Court can make law. Not legally anyway.

Equal protection clause
All the quibbling aside, the homosexuals stand on the equal protection under the law clause, which does apply, but not the way the Homosexuals want it to. If one is equally protected under the law then the law applies to every one equally. Therefore homosexuals are protected under the same law that heterosexuals are---equally. You see, the issue is equal law for equal people. Homosexuals do not want to be protected equally under the law as the law states; they want to have a special law that protects just their small social group, and folks, that ain’t equal.

Then they run and play the race or gender card
Homosexuals then want to use the discrimination law, of gender or race. Again, it doesn’t hold water, because gender and race discrimination are not the issue here. Homosexuality is a choice gender and race is not. Then of course they run again and say that homosexuality is not a choice either. This my friend, then needs to be defined and proved scientifically and in the court, so far is has not.

The people say that it is not legal to marry more than one partner, and or not legal to marry your pet. People say that it is not legal to marry a child; and it is not legal to marry someone of the same sex. The people have spoken, but will the Democratic Government listen to the people, or has America already become a totalitarian police state dictated by the law of the court and the dictatorial minoity.

So if you thought this was over, well--- think again, this is not a Republic any more, where laws were absolute and your government electorate represented you. A democracy, as I have always said, is nothing less than MOB RULE and will always lead to a dictatorship, when the unelected judge can make law, then the judge rules, and the people do not.

Think about it. A Government for and by the PEOPLE this is not.
